Land Use Issues

The Planning Office deals with land use issues including divisions of land 160 acres or less (subdivisions), family transfers, parcel retracements, etc. All land use issues are reviewed in accordance with Montana Code Annotated - Chapter 76 and the Fergus County Subdivision Regulations. This office is also the regulatory agency for the Fergus County Floodplain Hazard Regulations and handles permitting in the FEMA designated floodplain.

Our office also works in cooperation with the Fergus County Clerk and Recorder's Office by providing a preliminary review of plats, certificates of surveys and all recorded documents relating to land use.

The Planning Office also work with the County Road Department on a variety of things including encroachments in the county road right-of-way. Please fill out the ROW encroachment application for changes to or new encroachments in the county right-of-way. Completed forms should be returned to the Planning Office with the required fee.
